These standards were developed by a group of civil rights orgnizations in consultation with background checking companies and represents high standards that employers and Consumer Reporting Agencies can reasonably be expected to follow.

The standards set out concrete, practical procedures that will help employers make hiring decisions that:

  • Comply with the EEOC Guidance and limit liability under the Title VII of the Civil Rights Act and state and local anti-discrimination laws.
  • Comply with the Fair Credit Reporting Act (FCRA).
  • Minimize the risk of liability from hiring an unfit employee.
